Course Overview:

Every year, impaired drivers cause thousands of traffic deaths and injuries. Prosecutors and law enforcement officers need the skills to be sure that the impaired drivers are charged with the proper DUI offense and that the summary suspensions are not rescinded. Additionally, with the passage of adult-use marijuana, DUI crashes have increased. This course will help instruct officers and prosecutors how to navigate a successful DUI investigation regardless of what the impairing substance may be.

Attendees will learn what section of the DUI statute is most applicable depending on the facts of their case. They will be provided with a brief overview of the various factors that can elevate a misdemeanor DUI to a felony-level offense. Additionally, this class will provide instruction on the most used Warnings to Motorists regarding the Illinois implied consent law. Officers will be able to recognize which Warning to read depending on the facts presented. The attendees will understand and appreciate the differences between the Standard Warning to Motorist and the Traffic Crash Warning. They will also be provided with information on how to handle investigations for suspects under the age of 21. Additionally, they will know how to amend their sworn reports and will also know how to testify effectively during the summary suspension hearings to avoid having the suspension rescinded. Hospital scenarios will also be discussed. This course will also include a practical session in the afternoon where various hypotheticals will be presented. Attendees will break into small groups to utilize the skills they learned in earlier sessions to apply to various situations, discussing what offenses should be considered and what Warnings could be used.
